Please carefully read these Terms and Conditions to get a better idea about Artista. If you object to anything in this Agreement or the Artista’s Privacy Policy, do not use the Website, Mobile app or the Service. These Terms and Conditions control the access to and use of the Artista located at world of ArtistaJobs.com and the associated mobile application. These Terms and Conditions are applicable for both users registered as Talents and Recruiters in Artista. By using Artista, you agree to be bound by these Terms of Use (this "Agreement"), whether or not you register as a member of Artista. Artista is not a talent agency, employer, or talent group (Artista is an artists networking site). Artista is only a platform to connect the Artists and Recruiters. Artista does not promise or facilitate employment. The number of openings available varies by location, roles available and the level of experience required. As with any business, results may vary and will be based on individual capacity, experience, expertise, and level of desire. There are no guarantees concerning the level of income the user may experience. The images or videos uploaded by the customers in Artista are not protected.

Payment

To receive the subscription services customer must link a valid credit card or debit card on file with Artista’s payment processor. Subscription will be billed early. By agreeing to this Agreement and Authorised payment method, the customer allows Artista to draw money from their account as per their subscription plan. The customer has to pay fees according to Artista’s current pricing information. If the pricing of Artista changes in the future, we will notify the customers via email. If the customer fails to make an Authorised payment method, Artista has the complete right to immediately suspend or terminate the customer’s account.

Refund Policy

We don't sell any products through this app. We only charge registration fees from the users. Therefore, refunds are not available.

Subscription Cancellation

The customers can cancel their subscriptions or accounts at any time by emailing us at artistajobs.com or visiting their settings page. In order to avoid the subscription fee for the next year, the customer has to cancel their subscription before it renews. The cancellation will become effective at the end of the yearly subscription period.

EXCEPT AS REQUIRED BY APPLICABLE LAW, ARTISTA WILL NOT PROVIDE REFUNDS FOR ANY SUBSCRIPTION. WE DO NOT PROVIDE CREDITS, REFUNDS, OR PRORATED BILLING FOR SUBSCRIPTIONS THAT ARE CANCELLED BEFORE THE END OF THE SUBSCRIPTION PERIOD. In such a circumstance, you will continue to have access to your subscribed services until the end of the yearly billing cycle.

Account Security

Artista has no responsibility in maintaining the confidentiality of your username and password that you provide during the Registration process or the images or videos you post in your profile. Artista won’t supervise the unauthorized use of your username or password or any other breach of security. You have to make sure that you exit from your account at the end of each session. ArtistaJobs.com will not be responsible for any loss or damage arising from your failure to obey with this provision. Be cautious when accessing your account from a public or shared computer to avoid the breach of your account privacy. Artista charges for subscription fees only. We will not ask you for any money other than the subscription fees. Artista will contact the users only for the verification process. Artista won’t be responsible for any kind of fraudulent calls that the users receive in Artista’s name.

Non-Commercial Use

Reproducing, copying, selling, reselling or exploiting any part of the website or App of Artista for any commercial purposes is considered illegal. Collecting usernames or email addresses of users by any means for the purpose of sending unsolicited email and unofficial framing of or linking to the Website may be investigated and proper legal action will be taken.

Contents Posted By ARTISTA

• a. The website and app of Artista contains copyrighted materials, trademark and other confidential information about ArtistaJobs.com and its licensors. All the contents posted by Artista, except the information which is in the public domain or for which you have been given written permission cannot be copied, modified, published, transmitted, distributed, performed, displayed or sold under any circumstances. ArtistaJobs.com has the complete ownership and retains all proprietary rights in the website and the app.
• b. The opinions, advice, offers, opportunities or any other content or information made through the Artista website or app, but not directly by ArtistaJobs.com, are those of their respective authors and cannot be verified or be relied upon. For such contents ArtistaJobs.com wouldn’t be responsible. ArtistaJobs.com doesn’t (i) guarantee the accuracy, completeness, or usefulness of any information on the website or app, or (ii) adopt, endorse or accept responsibility for the accuracy or reliability of any opinion, advice, or statement made by any party that appears on the website/app. ArtistaJobs.com or its affiliates won’t be liable for any loss or damage resulting from your dependence on information or other contents posted on the Website/App or transmitted to or by any Members.

Contents posted in ARTISTA by artists or recruiters

• a. Artists or Recruiters will be solely responsible for the contents that they publish, display or post on the website or app of Artista or transmit to other users. No artists or recruiters should send any kind of defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any other material that violates another person’s right (including, but not limited to, intellectual property rights, and rights of privacy and publicity). Make sure that you not provide inaccurate or any false information to any member or to any other company.
• b. As between you and Artista, you own the content and information that you submit or post in Artista, but you also grant us a non-exclusive license to use it.

User Interactions

• a. Artista is not liable for the Artists interactions with other members or recruiters and vice versa. Artista doesn’t conduct any criminal background check on its Artists or recruiters. Artista gives no guarantee to the conduct of its current Artists or Recruiters.
• b. Under any circumstances Artista won’t be liable for any damages, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the service, including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other registered users or persons you meet through recruiting companies. The Artists should take precautions in all interactions with other members of the service. Artista doesn’t promise your success. Never provide your financial information (Your credit card, debit card or bank account details) to anyone. If any fraudulence happens through the Artista app or website, we won’t be responsible for it.

Notifications

ArtistaJobs.com will provide both the artists and recruiters with notices, including those regarding openings and applications to this Agreement, developed by email, regular mail, SMS, MMS, text message or postings on the website or app. You won’t be getting such notifications if you violate the agreement by accessing in an unauthorized manner. So, you must agree to access the website or app in an authorized manner.

Prohibited Activities in ARTISTA

If an Artist or Recruiter misuse the service then Artista have the right to suspend or terminate their membership. The following is a list of the type of actions that you may not engage in.

• Impersonation of any person or entity.
• Stalking or harassing any person.
• Never express or imply that any statements you make are endorsed by ArtistaJobs.com without our prior consent.
• Never reproduce the index, navigational structure, presentation of its service or its contents by using any robot, spider or any other application, or other manual or automatic device or process.
• Never remove any copyright, trademark or other proprietary rights notices restrained in the service.
• Never post fake job openings in Artista. If we spot any fake posts, Artista has the complete right to suspend or terminate the respective recruiters account.
